At this point, the <br />Division has not basis for initiating bond release at the site. As explained <br />in the Division's correspondence of November 21, 1989, the bond release <br />procedure requires initiation on the part of the permittee with submittal of <br />an application containing all required information and demonstrations. In <br />that same correspondence, and in meetings early in 1989 the Division made <br />suggestions as to a course of action (post mining land use change) which TBM <br />might undertake to expedite bond release. To date, the Division has not <br />received any information from TBM to indicate that course of action has been <br />pursued. <br />While the Division acknowledges the situation at the mine with the loss of <br />leases and eviction from the property, TBM remains the permittee and the party <br />responsible under the statute. The Division believes that it is T8M's <br />responsibility to initiate and pursue solutions to the concerns raised by the <br />Division. <br />In order that resolution of the concerns progresses, the Division proposes to <br />schedule a hearing before the Mined Land Reclamation Board in May 1990 for <br />discussion of the situation and request fora decision by the Board on which <br />course of action to pursue in this situation. <br />In the interim, if TBM would like to pursue previously discussed options, the <br />Division would be available to assist. <br />If you have any questions please feel free to call. <br />Sincere <br />Michael S.
