TI ~e.c, ~ /-~ta~i,~ <br />Dear Mr. Headley: <br />Last fall I informed you via certified letter and telephone conver- <br />sation of the permit requirement to carry on a mining operation. <br />You have failed to submit an application for your mining operations <br />and consequently have not been issued a permit prior to mining at the <br />subJect location. On April 30, 1980, I inspected this site and found <br />that you were in operation contrary to law. <br />This matter will be on the Agenda for the Hay 29, 1990 hearing of tho <br />Board, which will commence at 9:00 AM and will be held at 1313 Sherman <br />St., Room 110, Denver, Colorado. At that time, the Board will consider <br />the Issuance of a cease and desist order and leyying a civil penalty <br />against you for vlolatlons. Your attention is called to the following <br />provision from C.R.S. 1973, 34-32-123: <br />"Operating without a Permit ^ penalty <br />(1) tthenever an operator or pro8~actor <br />falls to obtain a valid permit or file <br />notice of intent under the provisions <br />of this article, the board may issue an <br />immediate cease and disistoodder. Con- <br />currently with the issuance of such an <br />order, the Board mey seek a restrelning <br />order or InJunctlon pursuant to .see. 34- <br />32-124(3) <br />(2) Any operator who operates without <br />a permtt....shall be subJect to a civil <br />penalty of not less than one hundred <br />dollars per day nor more than one thou- <br />sand dollars per day during which such <br />violation occurs." <br />(cont'd) <br />
