This responds to your letter dated August 3, 1993, concerning the technical revision application for a permit to conduct coal mining operations by Basin Resources, Inc., 14300 Highway 12, Weston, Colorado 81091 at the Golden Eagle Mine located in Sections 15, 16, 17, 18, 19, 20, 21, 22, 27, 28, 29, 30, 31, 32, 33, and 34, Township 33 South, Range 67 West; and Section 3 and 4, Township 34 South, Range 67 West, Las Animas County, Colorado. The U.S. Fish and Wildlife Service provides the following comments which have been prepared under the provisions of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et. seq.). Because of the information provided in your letter, we believe it is unlikely, due to the small size and location of the project area, that there would be any affects on any threatened or endangered species by the project. Therefore, the Service concurs with your finding of no effect by this proposed revision of the current permit. You should contact the Colorado Division of Wildlife to address any concerns it may have.
