The duration of damage was determined to be long, as it will not be <br />possible to remove the material which had been spoiled down the outslope of <br />the mine bench. The extent of damage was determined to be small due to the <br />Limited amount of material spoiled downslope, resulting in a value of 2 under <br />the extent of damage category. After performing the necessary calculations, the <br />ending assessment under seriousness for N.O.V. 81-44 was determined to be <br />$875.00. <br />Fault - 5.04.5(2)(c) <br />Violation 8I-44 was determined to be the result of a greater degree of negligence <br />than reckless knowing or intentional conduct.
