Memorandtnn <br />To: Kent Gorham <br />From: Janet Binns. <br />Date: 4/05/200 <br />Re: Raton Creek Mine, C-1982-055, Midterm Review Responses <br />Kent, after talking with you today I revisited the wording Energy Fuels has in the permit <br />regazding reclamation success vegetation sampling. The 5`h pazagraph on permit page 519 <br />states, "A thorough evaluation of the revegetation success will be conducted in the last two (2) <br />yeazs prior to request for final bond release. This data will be used for the bond release <br />application. If successful criteria aze not met at that time, evaluations will be conducted every <br />second year until successful revegetation is demonstrated." <br />So, re-reading this statement would indicate that sampling will occur in year 9 & 10, <br />regardless of outcome. Should either sampling event fail to meet reclamation success criteria, <br />sampling will be conducted in yeaz 12. If standards are still not met, would EF not sample <br />until year 14? The wording is awkward. I don't know that EF needs to change the wording or <br />if we just need to confirm with Energy Fuels whether this indeed is the intent of the wording. <br />My second item, clarifying what will be sampled for productivity success determination. If <br />Energy Fuels provides wording to the permit text like that in their midterm response cover <br />letter, any confusion with the current permit wording should be cleazed up. <br />
