Long <br />Dimswn Director <br />1 have reviewed the plan submitted to you by Powderhom Coal Company to accomodate <br />permanent discharge from the South Portal of the Roadside/Cameo Mine. <br />My position is simple. The Division should not accept or approve a plan such as this involving <br />permanent monitoring of the site. Particularly given the stability of the company, it's not clear <br />who would perform the regular monitoring activities and under what auspices. Certainly, <br />approving a plan for which the operators themselves pose the potential of catastrophic <br />consequences for failure would be irresponsible on our part. That possible failure could result <br />from improper or inadequate maintenance and we have no assurance that the system could or <br />would be maintained. <br />One of the alternatives should be pursued, most likely the insertion of a permanent dischazge <br />pipe into an appropriate level (or levels) of the mine, large enough to forstall clogging. A <br />backup or secondary pipe would also be advisable, each large enough to accomodate the <br />predicted discharge individually. <br />1 recognize that this is a tight situation and the operator is encountering difficulties, but the <br />Division has got to take a stand and accept the consequences. <br />I recommend "Do Not Approve." <br />cc'. ~1 r7e~r~ <br />
