NOV C-93-115 <br />Golden Eagle Mine <br />This NOV was issued for failure to provide six months notice of <br />undermining to surface owners. <br />HISTORY <br />Ten NOV's and CO's have been issued at this mine in the past twelve <br />months. These area NOV's C-93-013, 014, 015, 016, 017, 018, 019, <br />069, 070 and CO C-93-012. $700 is assessed for history. <br />Although not all surface owners were notified of undermining in <br />accordance with Rule 4.20.2, the operator is committed by the mine <br />permit and the law to mitigate any subsidence related damages. No <br />subsidence related damages to structures have been demonstrated in <br />relation to the Golden Eagle Mine. $250 is assessed for low <br />seriousness. <br />FAULT <br />The operator had made efforts to notify some of the known surface <br />owners six months in advance of undermining. Apparently, owners <br />not receiving six month notification had purchased land following <br />notification of previous owners. Therefore, $250 is assessed for <br />a lesser amount of negligence on the operator's part in notifying <br />current surface owners. <br />GOOD FAITH <br />Good faith is not applicable at this time since the NOV has not yet <br />been abated. <br />
