Burgmaier: <br />We have completed our review of Seneca Coal Company's Yoast Mine Permit <br />Application Package (PAP). The PAP was reviewed for the following: <br />Compliance with soecial lease stipulations and agency recrulatione. <br />- No compliance problems were identified with the special lease <br />stipulations. <br />(a) Cultural resource inventories are included and proper on-going <br />consultation documented. <br />(b) Paleontological resources are not addressed in the mine plan <br />specifically, however, the federal lease stipulation adequately <br />identifies measures to be taken in case of discovery of fossils <br />during operations. <br />(c) No surface disturbance ie proposed in the area identified on the <br />lease ae Fragile Soils. <br />Analysis of lands unsuitable for surface mining and reclamation pursuant to 43 <br />CFR 3461. <br />- Through our land use planning process, none of the lands contained in <br />the affected federal lease CGC088199 have had unsuitability applied. <br />Unsuitability criteria were applied to the lands added to lease <br />COC0114093 prior to lease modification. Pursuant to 43 CFA 3461.3-2 we <br />do not apply unsuitability criteria to leased lands. No unleased <br />federal lands are proposed to be affected by mining within the mine <br />permit area. <br />Conflicts between goat-mining land uses and existing BLM land management plans <br />and policies. <br />- Although this mining operation will not have significant overall impacts <br />to wLldlife habitat, we recommend that the latest techniques in woody <br />plant species establishment be used in an effort to replace the <br />disturbed aspen and mountain shrub communities that are essential to <br />many species of wildlife, particularly neotropical migratory birds. No <br />other conflicts were identified. <br />Adeauacv of measures to protect federal resources not covered by the rights <br />granted by the federal coal leases. <br />- No problems were identified under this issue. <br />
