Box 15449 Division Director <br />Oklahoma Clty, Oklahoma 731$5 / Natural Resource Trustee <br />Weather Letter V <br />Re: Lucky Strike Lode, Permit No. M-1982-020, Succession of Operator (SO) Request, Option A, Weather Delay. <br />Dear Mr. Nossaman; <br />On February 5th, 2007, the Division of Reclamation, Mining and Safety received your request for a Succession ofOperator for the <br />above referenced permit. You have requested that the Division recalculate the reclamation liability for the site under option A. <br />Due to weather and ground conditions, the Division is been unable to inspect your site to determine the current on site conditions <br />which is necessary in order to accurately calculate the liability, In addition, there are five problems noted in the September 6ih, <br />2006 inspection by Specialist Steve Shuey that have not been adequately addressed. The issues of importation of ore and the <br />toxicity of tailings must be resolved prior to any accurate estimate of the reclamation liability. <br />The Division will continue to monitor weather and ground conditions and will inspect the Luck Strike at the earliest possible time. <br />A conservative estimate is mid to late April, groundcover dependent. In the mean time, you should contact the present operator to <br />address the outstanding problems. You will become responsible for any on site conditions once the SO is completed. In <br />particular [he ore importation and testing of mill tailing for toxicity have a direct impact on any calculations the Division may do. <br />Alternatively, you may also elect to go with Option B and post the current calculated liability bond and complete the SO and the <br />Division will recalculate the bond as early as possible as well.
