We find it
incomplete with respect to information required by both Rule 3.03.211) and by our
recommended :submittal format outlined in the enclosed Handbook Memorandum entitled
Bond Release on Permanent Program Areas. Please provide the following information to
make the application complete:
11 The date the permit was approved;
2) The acreage for which release is requested;
3) The legal description of the site;
4) Copies of the written notice to seek release to parties
identified in Rule 3.03.2(1);
5) The affidavit of publication indicating that Kaiser is seeking
release on the site per Rules 3.03.2(1)(bl and ic) and
2.07.312);
61 The map and table documenting the topsoil replacement
depth;
7) The vegetation map showing both the reference area and the
reclaimed areas.
On a related matter, the determination of the completeness of an application does not
have any bearing on the Division's decision to grant Phase II Bond Release. As such, we
would like to take this opportunity to forewarn you of a concern we have regarding the
revegetation success at the mine. As you are aware, the Division sampled at the site on
September 1 and 2, 1992. The Division found that the reclaimed area had attained 31.6
percent vegetal:ive cover and the reference area had 44.75 percent, demonstrating that
only a 70.6 percent cover had been established. These figures seemed to vary
significantly from the 28.6 percent and 28 percent (101.2 percent) found by your
sampling. This discrepancy suggests that the Division should re-sample the site next
summer prior to any decision on bond release.
