Z 264 ~ 17 869 <br />RE: 12630 Highway 12; Tatum <br />(719)866-2612 <br />The City of Trinidad has advised us that the water problem in the meadow south <br />of our home is from a leak in the city line running though our property. Colorado 81091 <br />(719) 8683310 <br />Telecooier <br />Demand is hereby made that Basin Resources take immediate measures in <br />conjunction with the cooperation of the Tatum's to repair this leak, and return the <br />property to its pre-subsidence condition. <br />The City of Trinidad has not afforded us much time to repair the leak. If not <br />promptly repaired the City of Trinidad will turn off the water to our home rendering it <br />impossible for us to maintain our home and care for our livestock. <br />The instant problem was addressed during the original citizens complaint filed in <br />1993 and the civil trial. The "sink hole" was viewed by DMG, OSM, and Basin during <br />the initial investigation. This is an ongoing subsidence issue. <br />Mr. Henry Austin with OSM became aware of the ongoing damage and during <br />his inspection of the property on September 22, 2000. Mr. Ron Thompson with Basin <br />Resources, Inc. was made awaze of the ongoing damage on September 22, 2000. To date <br />Basin Resources, Inc. has made no attempt to repair the damage created by their mining <br />operations. <br />This is our formal notice of complaint against Basin Resources, Inc. for <br />subsidence damage to our home and property. <br />• <br />
