Mining activities were to push material down slope from a <br />previously established bench in the fan. The bench was described as being 400 feet long and <br />located approximately 60 feet above the base of the fan. Mining activities removed the bench but <br />then continued by excavating material from the toe of the slope. The result of excavation from the <br />toe of slope has produced steep slopes, estimated at 1 H:1 V and steeper. The steep slopes above <br />the excavation site exhibit evidence of instability. Active slumping has progressed approximately 200 <br />feet above the toe of slope and approaches County Road 25. County Road 25 traverses the alluvial <br />fan approximately 300 feet above the toe of slope. Response from the operator, dated June 2, 2004 <br />and received June 15, 2004, verifies that the slump scarp has advanced beyond the permit <br />bourdary. <br />SERIOUSNESS <br />Administrative - <br />Onsite damage -The chosen post-mining land use, rangeland, requires slopes no steeper than <br />3H:1 V. The steep slopes created by the excessive excavation may prohibit the operator from <br />accomplishing the requirements of the approved reclamation plan. <br />Offsite damage -Slump scarp has advanced beyond the permit boundary. Potential exists for <br />continuation of slumping and sloughing of material regardless of cessation of mining activities. <br />Health or safety hazard -The excessive mining activities appear to have undermined County Road <br />25. <br />STATUTE(S) VIOLATED AND DESCRIPTION <br />Section 34-32.5-116(4)(1) of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials, 34-32.5-101 et. seq., C.R.S. <br />Construction Materials Rule 3.1.5(3) <br />
