<br /> <br />P6M agrees to submit to the Division for approval <br />certified cross-sections of the post-mining topography in the <br />Moffat Area and a written explanation of those cross-sections <br />stating that convex lower slopes are not proposed for the final <br />post-mining topography. Upon approval of such cross-sections and <br />written explanation, the Division shall withdraw Stipulation No. 3 <br />from the Permit Renewal. <br />7.' Stipulation No. 4 of the Proposed Decision stated: <br />PRZOR TO COMMENCEMENT OF SURFACE COAL MINING ACTIVITIES <br />IN THE MOFFAT AREA OF THE EDNA MINE, THE PITTSBURG AND <br />MIDWAY COAL [MINING COMPANY MUST DEMOLdSTRATE THAT SURFACE <br />COAL MINING AND RECLAMATION OPERATIONS IN THE 61OFFAT <br />AREA CAN BE FEASIBLY ACCOMPLISHED WITHOUT INDUCING MASS <br />MOVEMENTS. THIS DEMONSTRATION WILL BE ACCOMPLISHED <br />THROUGH THE USE OF APPROPRIATE GEOLOGIC, GEOTECHNICAL <br />AND HYDROLOGIC INVESTIGATIONS. THE MINE PLAN AND THE <br />MINING METHOD ARE TO BE ANALYZED TO QUANTIFY THE <br />RELATIONSHIP BETWEEN THE EXTRACTION OF THE WRDGE SEAM <br />COAL, THE STABILITY OF THE HIGHWALL AND UPSLOPE AREAS, <br />AND THE STABILITY OF THE POST-MINING BACKFILL. <br />NO DISTURBANCE OF THE MOFFAT AREA SHALL TAKE PLACE PRIOR <br />TO THE DIVISION REISSUIt7G WRITTEN FINDINGS IN ACCORDANCE <br />WITH RULE 2.07.6(2) THAT SURFACE CORL MINING AND <br />RECLAMATION OPERATIONS CAN BE FEASIBLY ACCOMPLISHED. <br />P&M has prepared and submitted to the Division appro- <br />priate geologic, geotechnical and hydrologic investigations <br />demonstrating that surface coal mining and reclamation operations <br />in the Moffat Area can be feasibly accomplished without inducing <br />mass movements. The Division agrees to reissue written findings, <br />in accordance with Rule 2.07.6(2) of the Rules, that surface coal <br />mining and reclamation operations can be feasibly accomplished in <br />-8- <br />
