TOXICITY CHARACTERISTIC (TC) RULE NOTICE
WIIAT HAPPENS IF I DON'T
COMPLY? ARE TIIERE
PENALTIES?
Anyone that violates any RCRA
requirement can be assessed substan[ial
penalties. In addition, there are criminal
penalties for knowing or willful violations
of the hazardous waste requirements.
Federal statutes also provide for criminal
prosecution for anyone who either provides
false information or knowingly fails to
ptcvide information to the government.
W]'[ERE CAN I GET ADDITIONAL
INFORMATION REGARDING
TIIESE REQUIREMENTS?
Thr full text of the Cederal hazardous waste
requirements can be found in the Code of
Essleral Regulations which is available at
many public libraries and most colleges.
Aslc your librarian to see Title 40, Parts
261'.-265 of the Code. Many trade
associations, both national and local,
provide information and/or assistance on
the requirements of environmental laws.
Cht:mical vendors may have information
which will help you judge if your waste has
the potential foe being characterized as
hazardous.
Waste can vary dramatically from one
operation to anotltcr, and sometimes the
only way to know absolutely if a waste
met:ts the hazardous characteristic is to test
for them. Because such tests arc
expensive, other available sources of
information should be utilized first.
