In order for us to approve this renewal application, we are required to affirm that the original finding that "the activities would not affect the continued existence of endangered or threatened species or result in the destruction or adverse modification of their critical habitats as determined under the Endangered Species Act of 1973..." remains valid. We request your review and recommendation pursuant to this finding, as well as your evaluation of the continued validity of the projections and assumptions of the mining and reclamation plan which relate to federally protected wildlife species. Applicable sections of the permit application are enclosed. Please advise us if you require additional information. In order for us to comply with regulatory time frames, we request that comments be submitted to the Division of Minerals and Geology at the above address by 5:00 p.m. on May 12, 1994. If no comments are received by this date, we will proceed on the assumption that your agency has no concerns with or objections to the applicant's proposal. A copy of the application is available for public inspection at the Routt County Courthouse in Steamboat Springs, Colorado. Written comments, objections or requests for an informal conference on the application may be submitted to, and additional information obtained from, the Division of Minerals and Geology, Room 215, 1313 Sherman Street, Denver, Colorado 80203, (303> 866=3567. Written comments, objections or requests for an informal conference must be filed at the Division by 5:00 p.m., within thirty days after the last public notice in the local newspaper.
