Specifically, bi-weekly water sampling reports were not submitted for the period fr m <br />December 1, 1993 to June 18, 1994. Quarterly sampling reports were not submitted in Janu 1994, and <br />April, 1994. <br />We believe this is in violation of the conditions of Permit No. M-88-112, pursuant to C.R.S. ~4-32-124 of the <br />Mined Land Reclamation Act 34-32-101 et sue., C.R.S. 1973 as amended. <br />Therefore, we have found reason [o believe a violation exists to Permit M-88-112 and the Lawland have <br />scheduled this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the May 24-25, 1995 Board meeting for consideration of possible <br />violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, eginning at <br />9:00 a,m. or as soon thereafter as the matter can be considered and you will have the opponun ty to be <br />represented and heard. It will be reiterated that there is reason to believe that you are in violas on of the <br />provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a cease and desist order, assess a civ I penalty in the <br />amount of $100.00 to $1,000.00 for each day of violation or order the permit be suspended, dified or <br />revoked. In addition it may set the matter for consideration of forfeiture of the $3,300,000.00 financial <br />warranty at a subsequent hearing.
