I have discussed these items with the <br />company and although they are, with one exception, relatively minor problems, they have <br />agreed that repair should be effected before the minor problems grow into major problems. <br />Following is a plan to address each area. <br />My client, Castle Concrete Company, disagrees with the need for a steep slope erosion <br />control plan in the form of a technical revision. That plan is already part of the reclamation <br />plan. Simply because there are some highly localized erosion problems does not necessarily <br />mean that the reclamation plan needs to be modified. I am sure you are aware that whenever <br />steep slopes are encountered, whether natural or produced by human action, local erosion <br />problems can occur, even under the best of conditions. There are many steep, reclaimed <br />slopes at this operation, and the erosion problems you have noted constitute otsty a tiny <br />fraction of the total area occupied by these slopes. It is therefore my position and my client's <br />position that the problems noted are simply management actions that need attention ;md do not <br />reflect on the adequacy of the plan for reclaiming slopes such as these. <br />Because Castle Concrete believes these are actually management actions uieeded for <br />producing a good final reclamation product, it is my client's position that no additional bond <br />is required. Tn other words, the existing bond provides for management of the reclamation that <br />has ah•eady been implemented. <br />Respectfully, <br />If you have any questions please call.
