It is the same as the <br />amended Ruling of the Referee, approved by the water Judge an xovember a1, <br />2006. As you know, the decree is in "conditional". Status. This means that <br />you have the water sight with the established appropriation date and with <br />npproval of the augmentation plan, However, in order to retain the water <br />right, you will be required to demonstrate due diligence in applying water <br />from BB Seep to beneficial use in accordance with the decree within the <br />six-year diligence period, Once you have actually diverted water from the <br />seep for the purposes approved in the decree, you should move promptly in <br />the Water Court t0 have the decree made `absolute^- An application for <br />conversion to absolute status can be made at any tiafe after use of the <br />water has occurred. If you do not put the water to use within the <br />diligence period, you may be able to keep the water right alive by <br />demonstrating diligent effort, including physical acts toward diversion oP <br />the water for the approved purposes in the diligence proceeding.
