OSM is in agreement with the <br />Proposed Decision. <br />The Colorado Department of Natural Resources, Division of <br />Minerals and Geology (DMG) conducted the Phase I Bond Release <br />inspection required at Colorado Rule 3.03.2(2) on October 24, <br />1995. DMG's Proposed Decision documents the inspection findings <br />and that all required public and surface landowner <br />notifications were made in a timely manner prior to the <br />inspection. The OSM Denver Field Division (DFD) participated in <br />the inspection and inspection findings are documented in the OSM <br />Mine-Site Evaluation Inspection Report dated November 08, 1995. <br />The United States Department of the Interior, Bureau of Land <br />Management (BLM) also participated in the bond release <br />inspection. DFD confirmed via telephone with BLM (MS. Janet Hook) <br />on February 27, 1996, that BLM had received and reviewed the DMG <br />Proposed Decision and would be providing a concurrence letter <br />that BLM agrees with the Proposed Decision. No other Federal Land <br />Management Agencies are involved in the Proposed Decision. <br />DFD understands that the total surface disturbed area of 4.96 <br />acres is privately owned and the coal removed was federally <br />owned. Areas specifically excluded from the Phase I Release <br />include the east yard berm; the access road to the bathhouse; the <br />sediment pond area which will be filled in; and the portion of <br />the pond embankment that will be breached. <br />
