An <br />assessment conference was held at the Division's office on September 7, 1995. In attendance <br />at the conference, in addition to yourself and me, were Tony Waldron, Christine Johnston <br />and Dave Berry representing the Division and Scot Anderson, Mike Savage and Jerald Fifield <br />representing Mountain Coal Company. if you agree with the penalty, please sign the <br />settlement agreement within ten (10) days as instructed on the form. If you disagree with the <br />settlement agreement, do not sign it. The Division will fix the penalty at the original <br />propesed,amount pursuant to Rule 5.043(5) and you may request a Board Hearing.
