(Operator} and with the authority to act on behalf of the Operator hereby <br />requests the following: <br />Colorado Marble, Inc. wishes to waive its rights to a 30 days notice for a hearing <br />to consider modification of the Board Order signed on April 7, 2007. It is my hope that <br />by waiving our rights we will finalize the permitting process. [n addition I would like to <br />address the Board to request suspending the outstanding civil penalties levied on April 4, <br />2006. <br />I look forward to seeing you on June 13`h to finally bring closure to Phis rather <br />extensive and exhaustive process.
