Based on the Division's recommendation, it is appropriate to order civil penalties totaling <br />$11,100.00 to be due and payable within thirty (30) days of the mailing date of this Boazd <br />order. The $11,100.00 in civil penalties is derived from three sepazate violations found by <br />the Board on December I5, 2004, specifically MV-2005-009 for $10,000.00, MV-2005-010 <br />for $1,000.00 and MV-2005-011 for $100.00. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Boazd hereby modifies its <br />prior Board orders in this matter to require all Board-ordered corrective actions to be <br />completed by June 30, 2006. Those corrective actions include, but aze not limited to, obtaining <br />a section 112 reclamation permit.
