Please respond at your earliest convenience so that <br />we may issue a decision no later than the previously specified decision date <br />of March 14, 1992. <br />1.) Please submit more detailed water quality analyses for the proposed <br />permanent ponds. We acknowledge receipt of the Discharge Monitor <br />Reports; however, two of the three indicate "No discharge". It will be <br />necessary to show, more definitively, that the water retained in the <br />ponds will be suitable for the intended use. Analyses should include <br />such parameters as pH, total dissolved solids, and representative metal <br />analysis such as iron, manganese, magnesium, etc. (4.05.9(1)(a) > <br />2.) Please provide the specific surveys, reports, etc., used to conclude that <br />pond water levels range from 0.5 feet to 3,5 feet (4.05.9(1)(b) ). <br />3.) The submitted information regarding Rule 4.05.9(1)(4) seems to conflict <br />with the statements provided regarding the Rule 4.05.9 (1)(b). The ponds <br />must retain water to be approved as permanent, and we must make the <br />finding that the water level is sufficiently stable so that they indeed <br />function as impoundments. If more than two acre feet of water are <br />impounded, then the water rights issues must be addressed. <br />Specifically, please indicate the amount of water that will be retained <br />in each pond below the primary dewatering outlet. Do you plan to gate <br />the outlets to provide for any additional storage? Also, please indicate <br />the manner in which you intend to address the enclosed letter from the <br />State Engineer (dated January 28, 1992). (Rule 4.05.9(1)(4) ) <br />
