page 2
JUDD JACQUEZ & ARNOLD P.C.
Atto~neys At Law
Which "compliance" requirements are being met for the process water
monitoring sites, the tailings pond, and collectio pond --- the
requirements of the permit level of cyanide or the Division level
of cyanide referred to in the February 24, 1993 report?
5. Leak Detection System Effluent Containment
A commitment from Battle Mountain Gold to repair the primary liner
is not sufficient. There must be a plan which outlines the
specifics so that speed and efficiency are maximizeb in the event
of a disaster. We do not feel there is such a plant.
8. Modification of Reclamation Plan
10. Amendment of Financial Assurance.
We will be addressing both of these issues at the scheduled August
19th meeting.
11. Critical Path Management Schedule.
We feel that this planning should begin as soon as TR008 is
approved.
72. Amendment of Monitor Samolina and Analysis Protocol.
Please see our comments under #2.
Additional Board Orders:
Under Q3 you indicate that permit standards are be rg enforced in
the active tailings pond. What about permit s andards being
enforced in the other areas?
We ask again. What are the cyanide levels of wat~r exiting the
tailings dam under drain system. Is the hydrogen peroxide
effective or should another procedure be explored.
Finally, we ask again that you include our experts, Scott Mefford
and Dave Hyatt in the mailings of your periodic, reports. We
realize that your time commitments are heavy, given the size of the
staff. Please know that we appreciate the ability to~ask questions
and make comments. We would like answers to our que~tions at your
earliest convenience. We will gladly respond to an questions or
comments you may have for us.
_ Sincerel ,
T -
Nora Jacq ez
Attorney at Lau
GREENWOOD EXECUTIVE PARK • 6458 SOUTH QUEBEC ST BLDG 5 • ENGLEWOOD, CO 80111 • 3031-290-8361 FAX 303-290-6228
