At that time you indicated that you were <br />not planning to progress on Stipulations 5 and i. until you had resolves the <br />pond issue. I understood you t0 sav that .you and your client did not yet have <br />a clear understanding of wnat was requires to satisfy Sttpulatton 5. I would <br />therefore like to take this opportunity to review the appropriate regulations, <br />our ooservations about the site ano an outline for your suomittal in response <br />to Stipulation 5. <br />Approximate original contour (AOC) is tlefined in Rule 1.04(}3) as a <br />post-mintng topography which resemples the Dre-mining topography, a landform <br />wnicn blenas in with the surrounding landscape and a physical conftquration <br />which results to the elimination of highwalls and spoil piles. Rockcastle <br />Coal Company proposed and the Division approves a post-mintng topography at <br />Grassy Gap on the Reclamation Map found in Volume 2 of the permit application <br />to meet Rule 2.U5.4(2)Ic). Rockcastle must demonstrate through the use of <br />certified as-built surveys that the proposed post-mining topography was <br />acm eved, and demonstrate to rougn reference to the tlefinitton and the <br />appropriate performance standards that AOC was achieved. The performance <br />stanaards are the Division's measures of compliance. Those associates with <br />approximate original contour are found in Rules 4.14 and 4.27. Rule 4.14 <br />SpeaKS to the timing, metnod and general grading requirements of backfillinq <br />and grading. Rule 4.27 discusses environmental design standards associated <br />witn steep slope mintng and reclamation. <br />The D1V1stOn 15 concerned spout the lmplomentdtl0n Of the prODOSetl to p0grdpny <br />and spout the associated long-term erosional staotltty at Pits 5 and 6. <br />Certified surveys of the two reclaimed pits may relieve the Division's <br />concerns spout lanaform estaoltshment. A demonstration of AOC as outlined <br />pelow is also required as part of the certification process and as a <br />Consequence ofi the difference in confiiguratton between the proposes reclaimed <br />topography and the constructetl to DOgraphy.
