Disturbance <br />boundary markers were installed during April and the <br />Violation "abated". Since that time new foliage has <br />obscured some of the markers such that it could possibly be <br />interpreted that the markers are not all "clearly visible". <br />The permitted location of the disturbance boundaries have <br />been reviewed with the intend of relocating the boundaries <br />to locations that are more readily visible without <br />destroying existing vegetation. At the same time, the new <br />boundaries must realistically mark the extent of existing <br />and anticipated future disturbance. <br />With this goal in mind, please accept the enclosed permit <br />revision for your review and approval. This minor revision <br />is requested to correct the disturbed area boundary for the <br />New Elk East and West Portal Areas. The boundaries have <br />been adjusted to reflect actual and anticipated future <br />disturbance along the steep southern slopes paralleling the <br />New Elk facilities. In no instance has the disturbed area <br />been increased, nor has there been any disturbance do to <br />mining in the deleted areas. <br />Enclosed are two draft copies of Maps 11 & I2 Surface <br />Facilities and Roads East and West Portals, and Maps 13 & 14 <br />Sediment and Surface Water Control Plan East and west <br />Portal, showing the proposed changes. Upon approval, <br />certified maps with these changes will be submitted for <br />insertion into the permit document. <br />
