" ... means a change in the permit or an application which increases the acreage of
the affected land, or which has a sign"rficant effect uaon the aparoved or proposed
Reclamation Plan. "
We feel that the Office's azbitrary interpretation of what they insist must be an amendment instead
of a Technical revision is unjustified by the clear invent of the Rules and Regulations and intent of
The Mined Reclamation Act. Such misinterpretation puts an extreme hazdship upon the operator to
re-start all the repetitive application procedures and notices. We suspect that their actions aze
intended to inflict a punitive hardship on the Operator, which actions are the sole prerogative of the
Boazd, not the Office.
MlESR SikNDSTON£, I.ll: is therefore requesting an Administrative Appeal heazing per Rule 1.4.11,
to be conducted the same time as the upcoming Formal Hearing for consideration of a possible
violation, in order to rectify this injustice.
Sincerely, _ _
- - --
.........................................C
Douglas L.
