Simpson <br />Slate Engineer <br />~ 0 41991 <br />L91YIeion of Mfn~ram ~ wt?Rti'r <br />RE: Eckman Park Mine (Permit No. C-81-071) <br />Technical Revision Application No. 37 <br />Retention of Pond M as a Permanent Impoundment <br />Dear Ms. Binns:: <br />The Division of Water Resources has reviewed the referenced Technical Revision No. 37 <br />with regard to its impact on water resources and water rights and has the following <br />comments and observations: <br />11 The impoundment site as described by you is located in T5N, R87W, Section 25 <br />within the NW1/4 of the NE1/4 on Fish Creek. <br />2) This portion of Fish Creek is not currently designated as critical by the Division <br />Engineer (i.e., is not overappropriatedl. <br />3) The referenced structure appears, from map information on file in your office and <br />personal communication with you regarding the intended use for livestock, to be <br />non-jurisdictional. <br />Therefore, this office has no objection at this time to the proposed Technical Revision No. <br />37.
