Most importantly, the operator <br />has not submitted final hydrologic designs for these structures. <br />I do not consider that the Division has approved demonstrations <br />related to these structures to be placed into the permit. <br />Ia the interim since 1991, the Prospect Pond, Section 16 Fill and <br />associated structures have been built. Several structures <br />associated with the Prospect Pond and Section 16 Fill (the South <br />Collection Ditch, windrowed topsoil stockpiles and Section 16 <br />Ditch) have recently failed in their operation and have become the <br />subject of notices of violation, <br />i believe that the burden of blame for lack of approved <br />demonstrations and for the lailure of the structures, mentioned <br />above, lies with the operator. <br />
