Long <br />Division Director <br />We have received your application for a technical revision to your permit to conduct coal mining in Colorado. <br />Our initial review indicates that a!1 preliminary items required by Rule 2.08.4(5) have not been submitted. <br />Thus, your application is incomplete for the purposes of filing as of November 13, 1998. <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make your <br />application complete. Please provide the following information in a written response to the Division. <br />1. Rule 2.04.6(3)(a): Please provide specific information required as relates to the proposed mining of the <br />D-seam (D-seam thickness is already provided). If the information exists within the permit, please <br />provide precise references as tc its location. <br />2. Rules 2.04.7(2)/a) & (bi- Please provide the required information specific to Ell: Creek. If this <br />information exists within the permit, please provide precise references as to its location. <br />3. Rule 2.04.9: Please provide information regarding topsoil suitability (pazticle size distribution, soil <br />fertility, percent organic matter) and quantity available for salvage in the proposed disturbance area. <br />If this information exists with the permit, please provide precise references as to its location. <br />4. Rule 2.05.3(3)(a): Please provide drawings (plan views and profiles) of all surface facilities associated <br />with this application. Sufficient information needs to be provided to determine reclamation cost <br />estimates (see also Item 10 ). <br />5. Rule 2.05.3(a): This rule requires each operation plan to provide a description of all coal mine waste <br />disposal activities. The Division considers backstowing of underground mine development waste rock <br />as mine waste disposal, regardless of whether this material is first brought out of the mine. Please <br />provide a description of all backstowing of underground waste rock, for the approval of both DbIG and <br />MSHA. <br />6. Rule 2.05.6(3)(a)(i): The application is incomplete with regard to a description of the protection of <br />quality of surface water from adverse effects of the proposed surface activities. Alternatives to <br />sedimentation ponds are proposed but not specifically described, and the effectiveness of such <br />alternatives are not demonstrated. Please include in the application demonstrations for the protection <br />of surface water quality (runoff! from areas for disturbance. <br />
