Lung <br />Division Dneclor <br />I have received the Mountain Coal Company letter of December 17, 1997 requesting reconsideration of the Notice <br />of Proposed Civil Penalty for Notice of Violation CV-97-009, dated September 10. 1997. <br />It is my opinion that the arguments presented in the letter of December I7, 1997 are reasonable, and an amended <br />Settlement Agreement is attached for your consideration. <br />If you agree with the Settlement Agreement, please sign the document and return the signed form within ten (10) <br />days. If you disagree with the Settlement Agreement, do not sign the form, and the Division will fix the penalty <br />pursuant to Rule 5.04.3(5).
