BOARD JUSTIFICATION F~ THE AMOUNT OF THE CIVIL'PENALTY AND POSSIBLE <br />SUSPENSIONS. •"I'he Board may suspend portions of a civil penalty if it will assist in furthering the goals of the Act <br />through compliance and reclamation. <br />The total civil penalty shall be $5,000.00 based on SOdays ofnon-compliance at $100.001 day with $4,533.80 suspended <br />if all board ordered corrective actions are completed within the required time frames. <br />$466.20 is due within 30 days of the signature date of this document. <br />BOARD ORDERED CORRECTIVE ACTIONS: <br />Staff recommendations OR <br />X 2. Staff recommendation(s)with the following modification(s): <br />Staff recommendations; <br />Submit a complete 1 12 Construction Materials Reclamation Permit Application by September 18, 1998. This has <br />been done. <br />2. The operator shall post an interim reclamation bond in the amount of $37,750.00 by November 21, 1998 for the <br />disturbed area of 17.7 acres <br />3. Secure an approved Construction Material (1 12) Extraction Permit by December 18, 1998 if no objections are <br />received and by January 16, 1999 if objections are received. <br />Board additions; <br />4. Provide sufficient bond within 30 days of application approval. <br />5.
