Road <br />Palisade, CO 81528 <br />June 21, 2003 <br />Mr. Carl Mount & Ms. Erica Crosby <br />Division of Minerals and Geology <br />1313 Sherman St., Rm. 215 <br />Denver, CO 80203 <br />JUfV 2 7 1003 <br />Division ~/Minerals and Geology <br />Re: Amendment to Construction Materials Limited Impad (110) Permit for the Rod< Island <br />Operation - Permit # M 1998-052 <br />Dear Mr. Mount: <br />Attached is an Amendment Application fto the Rock Island Land Company, LLC <br />(RILC) Construction Materials Limited Impact (110) Permit for the Rods Island Operation <br />as required by the Colorado Revised Statutes 1973, 34-32.5-101, et seq. and by the <br />Construction Material Rules and Regulations of the Colorado Mined Land Reclamation <br />Board. <br />(970) 464.1171 <br />The situation is one wherein previously mined placer dredge tailing (spoils) up the <br />Swan River near Breckenridge, Colorado will continue to be put to a benefidat use as <br />aggregate products. Such operations are fairly common in the Breckenridge area. This <br />amendment will simply extend the operation upstream a short distance. <br />We have discussed this operation a number of times with you and Erica has been <br />to the site on more than one occasion. A brief history of recent construction materials <br />activities on the site is that the site was originally owned by 8&B Mining and leased to <br />Alpine Rock. In 1993, Alpine Rock obtained a 112 permit (# M-93-035) to mine 352 acres <br />in the area, including this site, and their right-to-enter was a lease from B&B Mining. <br />Subsequent)y, RILC purchased the property from B&B Mining and, in 1998, obtained a <br />110 Permit (# M 1998-052} to mine the area. <br />As far as we are aware, Alpine Rock's permit still encompasses this area. <br />However, you have indicated that DMG's fundamental charge is to ensure reclamation of <br />mined lands and that having two permits on the same parcel only increases the assurance <br />chat those mined lands would be reclaimed. Therefore, DMG has no problem with the fact <br />that two permts sometimes overlap and encompass the same piece of property. <br />RILC has been mining the placer dredge tailing since obtaining the permit, and, late <br />last year, obtained release of reclamation liability on 7.96 acres of the permit, leaving 1.94 <br />acres intact We now wish to amend the existing permit by adding an additional 8.00 <br />acres on to the end of the permit as shown in the attached application and maps, which <br />will bring the permit area back to 9.94 acres. Nothing has changed at the site. Therefore, <br />this Amendment is basically an edited version of the original application submitted in 1998. <br />We hope the Amendment meets with your approval.
