Revised Postmining Topography
Dear Mr. Green:
The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116,
Paragraph 4, of the Colorado Revised Statutes, that on February 15, 2002, an application to revise coal mining
operations at the Colowyo Coal Mine was considered complete for the purposes of filing. The revision was
submitted by Colowyo Coal Company L.P. All review and comment periods as provided in the Act and the
Regulations initiate from this date of filing.
This proposed technical revision to Permit C-81-019 revises the postmining topography of the reclamation plan.
The surface coal mining operation is on land located approximately 28 miles south of Craig. The permit area is
further described as follows:
All or portions of Sections 2, 3, 4, 8, 9, 1 Q 11, 14, I5, 16, 17, 20, 21 and T3N, R93 W; and Sections 13, 15, 22, 23,
24, 26, 27, 28, 33 and 34, T4N, R93 W; 6th Prime Meridian.
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of Axial and Ninemile Gap.
This technical revision application does not incorporate additional lands into the permit area and does not
otherwise alter previously approved permit conditions or mitigation measures except the configuration of
reclaimed, previously approved disturbed lands.
However, in accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we
must have your concurrence in order to approve this proposal. We are required to make a finding that "the
proposed operations will not adversely affect any publicly owned park or place listed on or those places eligible for
listing, as determined by the SHPO, on the National Register of Historic Places, unless approved jointly by [he
Board and the Federal, State, or local agency with jurisdiction over the park or place." Therefore, we request that
you submit comments regarding your concurrence with, concerns with, or objections to this proposal. [n order that
we may comply with regulatory time frames, we request that comments be submitted within fifteen (IS) days of
this letter. Please refer to the MOU when undertaking your review.
