Long <br />Division Director <br />1300 Broadway <br />Denver, CO 80203 <br />Re: Colowyo Coal Mine (Permit No. C-1981-019) <br />Technical Revision Application No. 56 (TR-56} <br />Revised Postmining Topography <br />Dear Mr. Green: <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, <br />Paragraph 4, of the Colorado Revised Statutes, that on February 15, 2002, an application to revise coal mining <br />operations at the Colowyo Coal Mine was considered complete for the purposes of filing. The revision was <br />submitted by Colowyo Coal Company L.P. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />This proposed technical revision to Permit C-81-019 revises the postmining topography of the reclamation plan. <br />The surface coal mining operation is on land located approximately 28 miles south of Craig. The permit area is <br />further described as follows: <br />All or portions of Sections 2, 3, 4, 8, 9, 1 Q 11, 14, I5, 16, 17, 20, 21 and T3N, R93 W; and Sections 13, 15, 22, 23, <br />24, 26, 27, 28, 33 and 34, T4N, R93 W; 6th Prime Meridian. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of Axial and Ninemile Gap. <br />This technical revision application does not incorporate additional lands into the permit area and does not <br />otherwise alter previously approved permit conditions or mitigation measures except the configuration of <br />reclaimed, previously approved disturbed lands. <br />However, in accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we <br />must have your concurrence in order to approve this proposal. We are required to make a finding that "the <br />proposed operations will not adversely affect any publicly owned park or place listed on or those places eligible for <br />listing, as determined by the SHPO, on the National Register of Historic Places, unless approved jointly by [he <br />Board and the Federal, State, or local agency with jurisdiction over the park or place." Therefore, we request that <br />you submit comments regarding your concurrence with, concerns with, or objections to this proposal. [n order that <br />we may comply with regulatory time frames, we request that comments be submitted within fifteen (IS) days of <br />this letter. Please refer to the MOU when undertaking your review. <br />
