On September 29, 1995, <br />BMRI responded to the Divisions adequacy concerns. On October 25, 19'15 <br />the Division found BMRI's responses to adequacy concern Nos. 1,2, 4, ~, 6, <br />7, 8, and 10 sufficient. <br />The Division found adequacy concern Nos. 3 and 9 insufficient. The <br />Division deems necessary that now that TR-018 has been approved it sl~otlld <br />be included in Rules 6.4.19 (7} and 6.4.19 (14). <br />All testwork for TR-018 has been completed and was forwarded to the <br />Division on October 19,1995 and February 5,1996 (Sequential Bitch Tests <br />and Humidity Cell Tests, respectively). This testwork does not lead to <br />the conclusion that acid generation may or will occur in the West Pit. <br />Rather, the results of the tests confirm the earlier conclusion that there <br />is no technical basis to suggest that acid generation could occur in the <br />West Pit. To date, BMRI has not received a response from youK~ office <br />regarding the most recent data submittals. <br />On the basis of all test results conducted to date, BMRI does not agree <br />that the West Pit falls under the definition of an Environmental <br />Protection Facility. TR-018 is not an Environmental Protection Facility <br />because there is no evidence of acid mine drainage and designlated <br />chemicals are not stored cr used there. <br />P.O.
