NOV C-91-002 was <br />issued for alleged failure to perform examination of sediment ponds <br />1, 2, 3, 4 and 5/6 for erosion and stability. NOV C-91-003 was <br />issued for alleged failure to conduct hydrologic monitoring. <br />Rockcastle received Notices of Proposed Amount of Civil Penalty for <br />these NOVs on May 28, 1991. <br />Pursuant to C.R.S. § 34-33-123(8)(b) and CMLRD Rule 5.04.3(3) <br />Rockcastle hereby requests an assessment conference regarding the <br />existence of these NOVs and the amount of the proposed civil <br />penalty. See Attachment A. <br />Rockcastle submitted documents on May 6, 1991 and May 20, 1991 <br />containing information regarding the above-referenced NOVs which <br />must be considered in the assessment conference. CMLRD Rule <br />5.04.3(1). Rockcastle will submit additional information regarding <br />the proposed civil penalties under separate cover. CMLRD Rule <br />5.04.3(3). <br />
