NOV C-91-034 <br />Southfield Mine <br />Failure to provide accurate ownership and control information in <br />the mine permit. <br />HISTORY: No violations in the past 12 months. <br />SERIOUSNESS: Seriousness of this violation is significant. The <br />Division, as well as regulatory agencies in other states and the <br />OSM, relies on information submitted in the mine permit to verify <br />the identity of owners and controllers of coal mines and their <br />compliance with State and federal law. Failure to supply this <br />information is an obstruction of the Division's ability to verify <br />compliance, as required by the coal act. <br />FAULT: Due to the fact that one of the owner and controllers of <br />the Southfield Mine is also an owner and controller of two other <br />permitted coal mines in the State of Colorado, and that this has <br />been the case for at least five years, failure to supply this <br />information in the mine permit appears to have been an intentional <br />decision by the operator. <br />GOOD FAITH: No good faith awarded. <br />c:\wp51\lpr\1r25f <br />
