The review is to determine whether a pattern <br />of violations exists or has existed, and, if a pattern exists, <br />whether we will require the operator to show cause why the permit <br />should not be revoked or suspended. <br />Powderhorn Coal Company was issued three notices of violation <br />during three separate inspections of the Roadside & Cameo Mines. <br />The citations, in brief, were: <br />March 15, 1993 Inspection <br />NOV C-93-009 Failure to provide certified inspection <br />reports of coal refuse disposal areas during <br />critical construction periods. <br />August 25, 1993 Inspection <br />NOV C-93-119 Failure to pass disturbed area runoff through <br />a pond or treatment facility before leaving <br />the permit area. Failure to design, construct <br />and maintain sediment control structures to <br />prevent to extent possible additional <br />contributions of sediment to streamflow or <br />runoff outside permit area and minimize <br />erosion. <br />September 15, 1993 Inspection <br />NOV C-93-121 Failure to maintain diversion of overland flow <br />of an ephemeral stream draining less than one <br />square mile. Deposition of coal material into <br />an undisturbed ephemeral drainage. <br />
