Lochhead
Enecoiive Director
Michael B. Long
Division Director
On September 8, 1995, the Division received an application for a Phase I Bond Release from
Western Fuels-Colorado for the New Horizon Mine. This request is specifically for 98.6 acres
within Area 3 at Mine 1 and 51.8 acres within Area 1 at Mine 2.
On September 11, 1995, the Division found this application incomplete for the following reason(s):
1. Proof of publication of the advertisement notifying the public of the submittal of the bond
release request has yet to be submitted. This is required per Sections 3.03.2(1)(c) and (d).
As we have discussed earlier this week, revisions need to be made to the proposed public notice to
provide a more precise location of the areas proposed for release. We also discussed the need to
include some additional adjoining landowners in your list of landowners scheduled to receive notice
of the submittal of the release request.
Should you have any questions, please contact me at (303) 866-3567.
Sincerely,
„i'l~~GS~/~ Jt~~
Daniel I.
