Hayden <br />F.xhibil "S», Page 8 <br />Permanent Mart-madeStruetures AGREEMENT <br />Triantos CravelPit <br />THIS AGREEMENT made and entered into this 11th day of December 1997 by and <br />between the County of Delta, State of Colorado (hereinafter referenced as the OPERATOR) anti Craig Allen & <br />Tammra Triantos, (hereinafer referenced as the OWNER). <br />WITNESSETH: <br />1. It is anticipated that the proposed mining operation of the Triantos Gravel Pit, located in part of the NW <br />1/4, SW 1/4, Sec. 21, TISS, R96W, 6th P.M. will at some poim fal! within 200 feet of OWNER'S <br />house as indicated on the attached map. The location of the house is well out of the proposed mining <br />operation plan and will not cause a problem. <br />2. The OWNER and OPERATOR hereby mutually agree that any damage effec[ed to the above memioned <br />structure, located on attached Exhibit "A", and caused directly or indirectly by the OPERATOR or his <br />employees or agents in the prosecution of work necessary to mine and process gravel from the subject <br />tract of ground shall be repaired by the OPERATOR. Said structure will be repaired to as near the <br />condition before damage as possible. <br />3.
