Long <br />Division Director <br />The Division has received Walden Coal Company's response to the Division's May 22, 1996 <br />letter regarding outstanding items from the Division's midterm review. The Division <br />understands the unresolved nature of the surface land owner issues. Holsinger Realry has <br />contacted the Division recently inquiring as to State jurisdiction on the property. The <br />Division still needs the permit updated to reflect the current surface landowner (Rule <br />2.03.4(6)). This should be updated even if negotiations are underway for sale of the <br />property. <br />In regards to the response to Division concern no. 37(k), a letter from Jackson County <br />clarifying that no reclamation of the existing septic system is needed would suffice to comply <br />with Rule 2.05.5(1)(b). Most likely the Jackson County planner would be the appropriate <br />authority for such a letter. <br />Please update the land ownership page of the permit and provide verification from the <br />County that the septic system may remain.
