O. Box 229
Boulder, CO 80306
Re: Bourg Mine (C-81-021), Mid-Term Responses dated June 27, 1996
Dear Mr. Patten:
I~~
DEPARTMENT OF
NATURAL
RESOURCES
Roy Romer
Governor
lames 5 Lochhead
E~eculive Director
Michael B. Long
Division Director
The Division has received Walden Coal Company's response to the Division's May 22, 1996
letter regarding outstanding items from the Division's midterm review. The Division
understands the unresolved nature of the surface land owner issues. Holsinger Realry has
contacted the Division recently inquiring as to State jurisdiction on the property. The
Division still needs the permit updated to reflect the current surface landowner (Rule
2.03.4(6)). This should be updated even if negotiations are underway for sale of the
property.
In regards to the response to Division concern no. 37(k), a letter from Jackson County
clarifying that no reclamation of the existing septic system is needed would suffice to comply
with Rule 2.05.5(1)(b). Most likely the Jackson County planner would be the appropriate
authority for such a letter.
Please update the land ownership page of the permit and provide verification from the
County that the septic system may remain. Should you have any questions, please call.
Sincerely,
r
anet H. inn
nvironm ntal Prot coon Specialist
STATE OF COLORADO
C81021\mtresp.709
