• <br />III. COMMENTS -COMPLIANCE <br />.~ <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Mike Boulay and Dr. Jim Pendleton both of the <br />Division of Minerals and Geology (DMG). The inspection was completed over the course of two <br />days. The inspection occurred on the afternoon of July 9, 1997 and was completed on the <br />morning of July 10, 1997. The primary focus of the inspection was a slope failure under and in <br />the fill of the main hauVaccess road being constructed as part of the Sylvester Gulch Facilities <br />(Permit Revision #07). Christine Johnston and Eric Mende of Mountain Coal Company <br />accompanied [he DMG during all of the inspection. On July 9, 1997, Henry Barbe of MCC was <br />present for a portion of the inspection. Philip Solseng, P.E. of Barr Engineering Company was <br />also present on July 9th to aid in determining the potential cause of the slide and to discuss <br />remedial measures that may be implemented. <br />Day One Inspection (7/9/1997): <br />Slides & Dama¢e <br />At approximately 2:45 p.m., the inspection initiated at the site of the slide that occurred along <br />a portion of the main hauVaccess road in Sylvester Gulch. Inspectors Pendleton and Boulay were <br />accompanied by Christine Johnston and Eric Mende of MCC and Philip Solseng of Barr <br />Engineering Company. The inspection began at the northern limit of the slide azea and <br />proceeded to the south along the top of the fill material placed on the hauVaccess road. After <br />investigating the entire width of the slide from on top of the fill, the inspection continued <br />downslope to the toe of the slide adjacent to Sylvester Gulch. Dr. Pendleton, Mr. Mende and <br />Mr. Solseng inspected the entire base of the slide. Dr. Pendleton's findings for the slide damaged <br />areas are presented below in the following 8 paragraphs. <br />Landslide -Main Access Road <br />According to MCC, the landslide commenced on July 4[h between approximately stations 62+00 <br />and 68+00 on the SGFA main access road. The road embankment had been partially constructed. <br />A maximum of approximately 30 feet of fill had been placed on the slope west of the Sylvester <br />Gulch channel. Following the slope failure, the toe of the embankment was approximately five <br />feet from the channel in places. The highest pull apart crack measured approximately five feet <br />across with approximately seven feet of vertical offset. The road is impassible. <br />Eric Mende of Mountain Coal's environmental staff has been compiling daily visual <br />measurements of crack growth. Eric's data show that the rate of downslope movement has <br />slowed, but as of our visit, was continuing at approximately 1 foot per day. Some transverse <br />cracking is apparent on the slope between the toe of the fill and the creek. No significant <br />
