<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />On the morning of July 10th, Mr. Boulay and Ivls. Johnston inspected the cut slope above the <br />IvISB. During the inspection, it appeared that a much larger quantity of subsoil had been <br />removed from the cut slope than was contemplated with the verbal approval. It also appeared <br />that construction involved areas which had not been disturbed prior to this project. According <br />to Ms. Johnston, topsoil from the cut slope has been segregated and stockpiled at Topsoil Pile <br />#5, and 16,000 cubic yards of subsoil has been removed for construction work. <br />At this point during the inspection on July 10th, Mr. Boulay requested that all activities <br />associated with the excavation and usage of materials from the cut slope above the MSB be <br />stopped until the work is appropriately permitted and bonded. Ms. Johnston indicated that no <br />further excavation of material from the cut slope above the MSB would occur until approval to <br />do so was granted from the Division. Ms. Johnston also indicated that a minor revision <br />application which includes a description and quantification of the materials used from the-cut <br />slope would be submitted via facsimile on the following day July 11, 1997. On July 15, .1997 <br />a minor revision application was received from MCC which addresses the expansion of the <br />Material Storage Bench and repair and control of slope movement in the area of the MSB. <br />7 <br />
