Long
Division Dveclar
This afternoon I spoke with Christine Johnston of Mountain Coal Company. I asked her whether
there has been any progress regarding the additional permitting required with NOV C-96-013. She
stated that there was no progress with any permitting and that they might get something done next
week when Scot Anderson comes to the site.
I reminded Christine that MCC had until July 31 to both permit and implement any changes.
Christine said she thought the NOV only specitied permitting, not implementation.
I asked Christine whether MCC continued to use the unpermitted subsoil pile, and she replied that
the west soil pile had been used to reclaim the west flank of the refuse pile. I asked her again
about the unpermitted pile (east), and she stated that the east pile is where most of the stored soil
material now resides. I asked why MCC proceeded with the use of an unpermitted pile, even after
the NOV had been written. Christine stated that she saw no difference between an east pile or a
west pile. I explained that the east pile was no[ pernritted, and I was concerned that MCC chose
to use the pile and has not provided any additional permitting.
Christine stated [hat she wasn't sure exactly what was occurring on the ground, so I asked
Christine to have Notm Avery give me a call this afternoon.
DABlbjw
\env\C96013.one
