Gunnison No. 1 Mine, C-80-007 <br />Dear Mr. Hagen: <br />On March 7, 1990 we received the above-referenced Ten Day Notice. This TDN <br />was issued based on an inspection conducted on February 21 and 22, 1990. At <br />the completion of that inspection the OSM inspector was unclear as to whether <br />a TDtJ would be issued. <br />After receipt of the TDN we re-inspected the Pot. Gunnison Mine site on March <br />8, 1990 to determine if a violation existed. This inspection demonstrated <br />that the three conditions referred to in the TDN did not exist at the mine <br />site. Wlore specifically, drainage from the small interface area between the <br />waste and the re soiled portion of the bench was routed off the pile and to the <br />east where it was intercepted by the 100-year diversion ditch. The 100-year <br />diversion ditch located at the southern edge of the waste pile was surveyed <br />and found to drain properly to the south and west. The Sylvester Gulch road <br />exhibited grades which directed all runoff into the roadside ditches and the <br />100-year diversion ditches. <br />Based on our March 8, 1990 inspection of the site we find that surface water <br />runoff from the fill and the area above the fill is properly directed to <br />diversion channels.
