<br /> <br />Ms. Joanie Berde - 2 - M~y 13, 1992 <br />(3) If the original ore samples did not adequately reflect t~e correct <br />amount of copper in the ore body (copper enhances cyanid toxicity) <br />- and winter conditions hinder this process - why did no the MLRD <br />conduct appropriate testing of this ore? <br />The Division must rely on data supplied by the applicant, The data <br />supplied did not indicate a problem with copper in termsiof <br />reclamation or tailings disposal. <br />(4) Why is the MLRD considering any lowering of standards to ;allow a <br />higher level of toxicity? <br />The operator is obligated to meet the cyanide level committed to in <br />the approved application. If the operator wants to than e the <br />level currently allowed in the tailings pond, then revision to the <br />existing permit must be filed, and approved by the Division. Any <br />change to the existing level dill likely be appealed to he Board <br />regardless of Division approval or denial. Thus, if a c ange is <br />requested, we expect that the Board will make the ultima a decision. <br />(5) What support does your Department have from EPA, the state <br />Environmental Department, and the Colorado Groundwater Division? <br />The Mined Land Reclamation Division is a purely state fun ed <br />program and receives no support from EPA. Colorado does of have a <br />state Environmental Department. Under Senate Bill 181, t e Mined <br />Land Reclamation Division is the state's implementing age cy for <br />ground water protection at mining operations.
