We are confident that once all of the <br />pertinent facts have been reviewed, the Division will agree that <br />Colowyo has indeed complied with the Colorado Surface Coal Mining <br />Reclamation Act and subsequent Regulations and a NOV is not <br />warranted. <br />structures by Colowyo. <br />The NOV was written for "Failure to pass disturbed area flow, <br />failure to protect offsite areas, failure to minimize additional <br />solids to offsite areas, failure to maintain collection ditch, <br />failure to maintain an excess spoil pile diversion ditch". Measured Precipitation and Duration <br />Actual measurements of the amount of precipitation and the <br />elapsed time from start to finish were taken independently at <br />two separate locations.
