Lang <br />Division Director <br />The Division of Minerals and Geology received the above-referenced <br />TDN on July 2, 1993. This letter serves as the Division's response <br />to the TDN. <br />The TDN cites an alleged violation of Colorado Rule 4.16.1(1) for <br />failure to reclaim disturbed area to the approved post mining land <br />use. The area in question is the former office complex area at the <br />Northern No. 1 Mine site at the Meeker Mines. A concrete pad and <br />associated structures were left in place after reclamation at the <br />land owner's request. <br />habitat. The Division approved retention of the pad and gravel <br />area as a minor revision to the. Meeker permit in September, 1985. <br />The Meeker Mine permit includes a request from the landowner for <br />retention of a concrete pad and adjacent gravel area for possible <br />future use as a home site and parking area. The designated post- <br />mine land use for the reclaimed mine site is rangeland/wildlife <br />Since the approved mine plan appears to be in conflict with the <br />Colorado regulations, the approval of retention of these structures <br />constitutes a permit defect. The Division has notified the <br />permittee that a revision to the permit must be submitted within <br />thirty days to address this permit defect. The Division will issue <br />a proposed decision on the revision within ten days of filing. If <br />the revision is not submitted within the prescribed time, <br />enforcement action will be taken. <br />STATE OF COLORADO <br />
