<br />Mr. Mike Toelle <br />May 13, 1998 <br />Page 2 <br /> <br />Enclosed is a copy of all listed down gradient wells, applications, <br />and well permits within Township 8 North, Range 69 west. This was <br />obtained from the Division of Water Resources today. The printout <br />indicates there are 30 such well permits down gradient from and <br />within 4.5 miles of the mine. Although some of the shallower wells <br />can be eliminated, this printout does not indicate the forniation of <br />completion for the deeper wells, and therefore some research of the <br />well records will be required to determine if any w~:lls are <br />completed within the Codell formation. This must be done to help <br />answer numbers 1 and 2 above. If potential wells are ident:ified in <br />the Codell Sandstone, then item number 3 above will ne~ad to be <br />addressed. In that case, Holnam will have 2 or 3 options including <br />installation of groundwater monitoring wells, providing a <br />demonstration that the contaminants will not mobilize, or <br />demonstrating that the contaminants will be diluted within the <br />aquifer to below groundwater standards before reaching any down <br />gradient wells. <br />As a reminder, the DMG is required to make an approval or denial <br />decision no later than today, May 13, 1998. We have not yet <br />received a complete response to my letter faxed to you ~~esterday <br />and will need to receive a response to the concerns outline=_d above. <br />Your responses should be submitted as soon as possible. ilnless we <br />receive from you a written waiver of your right to a decision by <br />today, May 13, 1998 and request for additional time, we will have <br />to deny this application. <br />If you have any questions, please contact me. <br />Sincerely, <br /> <br />Gary S.
