The Agreement between Louisiana Land and Gravel Company, LLC and Farmer's provides for a <br />50 foot wide buffer zone between its excavation operations and the centerline of the Gurley ditch <br />after the clay liner is installed. The agreement also allows Louisiana Land and Gravel Company, <br />LLC to stockpile material within 15 feet of the edge of the Gurley Ditch. <br />Excavation of the gravel pit will create a steep but stable advancing slopes. The slopes will be <br />reduced to a 2.Sh:ly before topsoil is applied and graded to depth. The advancing steep face will <br />be reduced [o a 2.Sh:ly slope when the pit is 125 feet from the centerline of the Gurley ditch. The <br />slope of the pit excavation immediately west of the 50 foot wide Gurley ditch buffer zone will not <br />be steeper than 2.SH:1 V at any time during the mining operation. The effective slope between the <br />edge of the Gurley Ditch and the pit floor will be about 3.8h:1 V assuming the ditch is about 20- <br />feet wide. Care will be taken to keep all activities and disturbance within the projected pit <br />disturbance boundaries. <br />A lazge portion of the projected disturbance aze within azeas where the vegetation can be <br />characterized as noxious weeds and cheat grass. Noxious weeds on the permit area will be <br />controlled per the Weed Control plan included in Exhibit J -Vegetation. <br />A small portion of the Phase III area is interspersed with wetland species. The applicant does not <br />believe this small azea is a jurisdictional wetland due to the influence of irrigation water. The <br />letter from the Corps of Engineer, located in Exhibit J, confirms that the wetland is not <br />jurisdictional. <br />The gravel deposit lies directly on a sandstone shelf. This sandstone has been determined to be an <br />aquifer. Drilling indicates ground water may be present in the lower 10 feet of the gravel deposit. <br />Mining experience will dictate to what depth the gravel deposit may be removed without <br />disturbing this ground water. If ground water is encountered, pit floor projections will be revised <br />to maintain a minimum of 2 feet of undisturbed material above the ground water. <br />The access road, which directs all truck traffic to all three phases of the gravel pit, accesses the <br />county maintained Redvale Road approximately 550' east of the nearest dwelling. The planning <br />of this road minimizes the effects of dust and noise generated by the operation on the rural <br />lifestyle of the local community. <br />Operating hours of the pit aze controlled the Montrose County Special Use Permit. <br />Overhead power lines as illustrated on the Exhibit C-1 Pre-Mining Map, cross the Phase I and <br />Phase II azeas. San Miguel Power Association maintains an easement for these structures. The <br />grave] operation will not affect the stability of these structures. <br />The only commodities to be mined are construction materials. Construction materials include but <br />aze not limited to pit run gravel, road base, and screenedlsized gravel. No secondary commodities <br />aze to be mined or extracted. <br />The construction products will be used for the production of asphalt, concrete and road <br />construction. The gravel products are also used as select and special fill for construction sites. <br />Sand and gravel will be washed as demand dictates. The main demand is for masonry sand. <br />D-3 <br />
